Unless provided otherwise below, the Dutch Forwarding Conditions, latest version, including the arbitration clause, as filed by FENEX with the court registry (registries) at the District Court(s) in Amsterdam (Rotterdam, Breda and Arnhem), are applicable to all our activities. The Dutch Warehousing Conditions, latest version, including the arbitration clause, as filed by FENEX with the court registry at the District Court in Rotterdam, are applicable to all orders which exclusively concern the warehousing of property. The General Conditions of transport 1983, latest version, filed with the court registry (registries) at the District Court(s) in Amsterdam (and Rotterdam), are applicable to agreements concerning national road transport. All of the aforementioned conditions will be supplied upon request or are available for downloading on our website under tools, documents.
We are implementing a new rule as of March 1st, 2012, stating that any account that invoices above 3 days overdue, which have not been disputed with our finance department, will have its credit suspended until these are resolved.
Moreover, Mearsk-line has implemented a fine 15% on overdue invoices, subsequently we have to add 15% on our overdue invoices when units are shipped via Mearsk-line.
Altough we know this is a hard decision, we think it is a fair one, since the agreement we have made with you regarding credit days is very clear. Furthermore, this rule will have no impact when the, by you confirmed, credit agreement is adhered to.
